Personal Data Protection (GDPR)
Energy Life Limited s.r.o., Korunní 2569/108, 101 00 Praha 1, Company ID: 6176887, email: energy.life.ltd@gmail.com (hereinafter referred to as “we”), protects all personal data provided to us during registration, ordering and/or purchase (first name, surname, address, telephone number, email) against misuse and processes such data in accordance with current legislation. We would like to use this document to inform you about certain new rules and information related to the new European legislation on personal data protection (the GDPR Regulation, effective in the European Union, and therefore also in the Czech Republic, from 25 May 2018), because the security of your personal data is our priority and at the same time we want you to continue using all our services without any restrictions.
In this document you will find basic and clear information about what personal data we process about our customers for the purpose of handling orders and registration in our online store, the legal grounds on which we process the data, the specific purposes for which we use it, to whom we may disclose it, and what rights you have in connection with the processing of your personal data.
- A. What personal data do we process?
We process the following personal data:
- identification data, in particular first name and surname, username and password;
- contact data, meaning personal data that allow us to contact you, in particular your email address, telephone number and postal address;
- your settings, meaning data in your account, in particular saved addresses and profiles and your ratings of products and services;
- data about your orders, in particular data about the goods and services you have ordered, the method of delivery and payment, including the payment account number, and complaint data;
- Why do we process personal data and what authorises us to do so?
- B.1.1 If you register with us, create an order or make a purchase
If you register in our online store at www.megadrops.eu, place an order with us or make a purchase, we process your identification and contact data, data about your orders and your settings (if you have an account with us), primarily for the purpose of fulfilling our contractual obligations (delivery of the ordered products), i.e. without your consent.
- B.1.2 Sending offers
If, when providing your contact details or at any later time, you do not refuse to receive offers, we may use your contact details to send offers by email, text message or other electronic means, or we may send them to you by post. These offers will concern our products and services. Your personal data provided to us when ordering goods or services, creating and using an account, or communicating with us, for example through a call centre, as well as data about your orders, your web profile, movement on the website or reading newsletters, are processed on the basis of our legitimate interest (i.e. without your consent) in order to create the most suitable messages about discount promotions or other offers, news and advertising that we send to you or display to you on megadrops.eu.
- C Who processes your personal data and to whom do we disclose it?
We process all the above-mentioned personal data as the controller. This means that we determine the purposes described above for which we collect your personal data, determine the means of processing and are responsible for its proper performance.
For the processing of personal data, we also use the services of other processors who process personal data only according to our instructions and for the purposes described in section B “Why do we process personal data and what authorises us to do so?” Such processors include:
- providers of cloud services and other technology and support suppliers;
- operators of marketing tools that help us optimise the website and personalise content and offers for you;
- providers of SMS communication and chat tools, where they process personal data in order to facilitate our communication with you;
- service providers involved in the processing of consignments, invoicing, catalogues and other communications, including in particular their delivery providers.
- D From what sources do we obtain personal data?
In most cases, we process personal data that you provide directly to us when ordering goods or services, creating and using an account, or communicating with us, for example through a call centre. We also obtain personal data directly from you by monitoring your behaviour on our website and when you read messages.
- E. Transfer of data outside the EU
As part of the transfer of data to recipients referred to in section C “Who processes your personal data and to whom do we disclose it?”, we may also transfer your data to third countries outside the European Economic Area, including countries that do not ensure an adequate level of personal data protection. Any such transfer will take place only if the relevant recipient undertakes to comply with the standard contractual clauses issued by the European Commission.
- F. What rights do you have in relation to the processing of personal data?
Right of access: You have the right to know what data we process about you, for what purpose, for how long, where we obtain your personal data from, to whom we disclose it, who processes it besides us, and what other rights you have in connection with the processing of your personal data. If you are not sure what personal data we process about you, you may ask us to confirm whether or not personal data concerning you are being processed by us, and if so, you have the right to obtain access to such personal data.
Right to rectification: To err is human. If you find that the personal data we process about you are inaccurate or incomplete, you have the right to have them corrected or supplemented without undue delay.
Right to erasure: In certain cases, you have the right to have your personal data erased. We will erase your personal data without undue delay if one of the following grounds applies: we no longer need your personal data for the purposes for which we processed them; you withdraw your consent to the processing of personal data, where your consent is necessary for such processing and at the same time we have no other reason to continue processing those data; you exercise your right to object to the processing of personal data that we process on the basis of our legitimate interests and we conclude that we no longer have such legitimate interests that would justify the processing; or you believe that our processing of personal data has ceased to comply with generally binding legal regulations. This right does not apply if the processing of your personal data remains necessary for compliance with our legal obligation or for the establishment, exercise or defence of our legal claims.
Right to restriction of processing: In certain cases, in addition to the right to erasure, you may exercise the right to restriction of the processing of personal data. This right allows you, in certain cases, to request that your personal data be marked and not be subject to any further processing operations — in this case, however, not permanently (as in the case of the right to erasure), but for a limited period. We must restrict the processing of personal data if: you contest the accuracy of the personal data until we agree on which data are correct; we process your personal data without sufficient legal basis (for example, beyond what we are required to process), but instead of erasure you prefer only restriction of such data (for example, if you expect that you would provide such data to us again in the future); we no longer need your personal data for the purposes described above, but you require them for the establishment, exercise or defence of your legal claims; or you object to the processing. For the period during which we assess whether your objection is justified, we are obliged to restrict the processing of your personal data.
Right to object to processing: You have the right to object to the processing of personal data carried out on the basis of our legitimate interest. In the case of marketing activities, we will stop processing your personal data without further action; in other cases, we will do so unless we have compelling legitimate grounds to continue such processing.
Right to lodge a complaint: Exercising the rights described above does not in any way affect your right to lodge a complaint with the competent supervisory authority. You may exercise this right in particular if you believe that we process your personal data unlawfully or contrary to generally binding legal regulations. In all matters related to the processing of your personal data, whether a question, exercise of a right, complaint or anything else, you may contact our customer service. Telephone enquiries: weekdays 9:00–18:00. Tel. +420 777 157 050. Written enquiries: megadrops@seznam.cz. We will process your request without undue delay, but no later than within one month.
